Australia is a common law country in which, traditionally, judges have been appointed by the Crown. The head of state in Australia is Queen Elizabeth II who is formally represented by the Governor General in the Commonwealth (that is of the Federal government) and by the Governor in each of the states. The formal act of judicial appointment is a commission by the Crown to an individual who is legally qualified to hold the office of a judge in a particular court. The judge formally then swears allegiance in accordance with the relevant formula applicable to the jurisdiction at a ceremony that may occur in private or in public depending upon the practice and tradition of the jurisdiction involved.
